General Terms

1. About Ruan Designs

Ruan Designs (PTY) LTD is a South African creative studio providing web development, hosting, graphic design, advertising, and printing services. These terms govern the use of all services unless a separate written agreement is in place.

2. Payment Terms

All services are billed as specified in the selected package or invoice. Payments are due on the invoice date. Late payments may result in service suspension. All prices exclude VAT where applicable. Payments are processed securely through PayFast or via EFT to our FNB business account.

3. Intellectual Property

Upon full payment, the client owns the final delivered content, media, and approved artwork. Ruan Designs retains the right to use frameworks, code libraries, and design systems across other client work unless exclusivity is negotiated. Ruan Designs reserves the right to showcase completed work in its portfolio unless a non-disclosure agreement is in place.

4. Cancellation

Either party may terminate any service with 30 days written notice. Upon cancellation, the client will receive a final invoice for outstanding amounts. Service access, hosting, and email will cease on the termination date. Website files and design source files will be provided as an export upon request.

5. Limitation of Liability

Ruan Designs shall not be liable for any indirect, incidental, or consequential damages arising from the use of its services. Total liability is limited to the amount paid for the service in the preceding 12 months.

6. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved through mediation before arbitration.

Web & Apps

1. Services

Ruan Designs provides web development, hosting, email services, domain registration, e-commerce setup, and custom web application development as described in the selected package. All services are provided on a subscription basis unless otherwise stated.

2. Domain Registration

Domain registration is subject to the registry's terms and conditions. Domain fees are billed annually and are non-refundable. The client is responsible for renewal before expiry. Ruan Designs will send renewal reminders but is not liable for lapsed registrations.

3. Hosting & Uptime

Hosting is provided on shared servers with a 99.9% uptime guarantee, excluding scheduled maintenance. Resource usage must remain within the allocated limits (4GB storage, 4 email accounts for the standard package). Excessive usage may require a plan upgrade.

4. Support & Maintenance

Support is provided during business hours (Mon–Fri, 8:00–17:00 SAST). Emergency support for critical outages is available 24/7. Content updates and feature requests are billed separately unless included in the plan.

Designing

1. Design Services

Ruan Designs provides professional graphic design services including but not limited to: corporate identity, branding, print design, digital assets, and packaging design.

2. Pricing

Subscription plans are billed monthly at R1,200.00. Once-off design items are billed from R450.00 per set with a 45-hour turnaround.

3. Revisions & Approval

Each design item includes up to 2 rounds of revisions. After V1.0 approval, changes may be billed separately.

4. Turnaround Time

Standard turnaround is 45 hours per design item from payment confirmation or request submission.

5. File Formats

Final deliverables are provided in high-resolution print-ready PDF and web-optimised PNG. Source files available at additional cost.

Advertising

1. Advertising Services

Ruan Designs provides digital advertising services including campaign creation, audience targeting, ad creative design, and performance tracking across platforms such as Google Ads and Meta (Facebook/Instagram).

2. Campaign Management

Campaign setup includes audience research, ad copywriting, creative asset preparation, and initial targeting configuration. Ongoing management includes weekly performance monitoring and optimisation.

3. Ad Spend

Client ad spend is billed separately from management fees and is paid directly to the advertising platform or reimbursed through invoicing. Ruan Designs provides transparent reporting on all ad spend.

4. Performance

While Ruan Designs optimises campaigns for best results, specific performance outcomes (clicks, conversions, sales) cannot be guaranteed due to external factors beyond our control.

Printing

1. Printing Services

Ruan Designs provides online printing and print brokerage services including business cards, flyers, banners, signage, apparel, and promotional products through our online store and partner print suppliers.

2. Artwork

Print-ready files must meet the specifications provided per product. Ruan Designs offers artwork design and repair services at additional cost. We are not responsible for print quality issues arising from client-supplied artwork that does not meet specifications.

3. Delivery & Turnaround

Turnaround times vary by product and are displayed during checkout. Delivery fees are calculated based on product size and destination. Ruan Designs is not liable for delays caused by courier services or events beyond our control.

4. Returns & Refunds

Due to the custom nature of printed products, returns are only accepted for manufacturing defects. Claims must be submitted within 7 days of delivery with photographic evidence of the defect.
